The problem of setting limits on stalemate - and checkmate for that matter - is even worse than you suggest. It is self-compounding. Consider a player whose only move(s) to keep - or get - out of check would result in a prohibited checkmate or stalemate of another player. Then the player to move is stalemated, or checkmated if already in check. So it has to be determined whether THAT mate is legal, and so on backwards. This would be true to an extent even were it true fo just checkmate, but adding it for stalemate does compound the problem.
